In order to be recertified as a civil trial advocate, the NBTA evaluates the lawyer on the basis of five criteria, including:
- Good standing with the bar(s) the attorney has been admitted to
- Substantial involvement, which includes dedicating at least 30 percent of his or her time to active civil trial litigation in the five years preceding recertification, as well as no less than 15 actual trial days.
- Educational experience, which involves the attorney’s participation in no less than 45 hours of educational activity.
- Peer review from at least six references.
- Disclosure of conduct. This requires the attorney to disclose any prior criminal charges, misconduct or disciplinary proceedings, or claims of professional negligence.
To be a board certified civil trial advocate is a symbol of expertise in this area of practice.
